This one-hour program will distill pathways and best practices for challenging PTAB decisions, emphasizing how recent and anticipated rule changes shape strategy. We will cover tradeoffs between direct appeals to the Federal Circuit under 35 U.S.C. § 141 and district court actions under 35 U.S.C. § 145, and well as how to best position the record for each during prosecution.

Whether you represent petitioners or patent owners, this session will provide actionable guidance to refine your briefing, strengthen the evidentiary posture, and calibrate strategic decisions in light of the PTAB’s evolving framework.
